If you create an account to buy, sell, or manage vehicle listings, you agree to provide accurate information and to maintain the security of your account credentials. You are responsible for all activity under your account. We may terminate or suspend your account at any time for violation of these Terms or misuse of the Services.


5. Purchases, Subscriptions, and Payments


When you make a purchase or subscribe through the Services, you agree to provide accurate payment information.


Payments are processed securely through third-party providers such as Stripe. By submitting payment details, you authorize us and our payment processors to charge your chosen method for the applicable amounts.


All sales are final unless otherwise stated in writing. Subscription plans renew automatically unless canceled before the end of the current billing cycle. You may cancel by contacting us at info@fourbieexchange.com.


Prices and fees are subject to change. We will notify you in advance of any material changes to subscription rates as required by law.


6. User Content and Submissions


By posting, uploading, or submitting content (“Contributions”) to the Services—including listings, photos, descriptions, or feedback—you grant Fourbie Exchange a worldwide, royalty-free, transferable, perpetual license to use, host, store, reproduce, modify, display, and distribute such content in connection with operating and promoting the Services.


You represent that:


  • You own or control all rights to your Contributions;
  • Your Contributions do not infringe, misappropriate, or violate any third-party rights; and
  • Your Contributions comply with these Terms and applicable laws.


We may remove or disable access to any Contributions that violate these Terms or are otherwise objectionable.


7. Third-Party Services


The Services may link to or integrate with third-party websites or platforms (e.g., payment processors, analytics providers, or partner marketplaces). Fourbie Exchange is not responsible for the content, accuracy, or practices of any third party, and your interactions with them are governed by their respective terms and privacy policies.


8. Privacy and Data


Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Services, you consent to our data practices as described there.

10. Disclaimers

We do not warrant that the Services will be uninterrupted, error-free, or secure, nor do we guarantee the accuracy or completeness of listings, user content, or third-party materials.


You assume all risk associated with your use of the Services.


11. Limitation of Liability


To the fullest extent permitted by law, Fourbie Exchange, Inc., its directors, officers, employees, and agents shall not be liable for any indirect, consequential, incidental, punitive, or special damages arising from your use of the Services.


Our total liability for any claim arising under or related to these Terms shall not exceed the greater of (a) $100 or (b) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.


Some jurisdictions do not allow certain liability exclusions, so portions of this limitation may not apply to you.


12. Indemnification


You agree to indemnify and hold harmless Fourbie Exchange, Inc., and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of:


  • Your violation of these Terms;
  • Your use or misuse of the Services; or
  • Your violation of any third-party rights.


13. Governing Law and Jurisdiction


These Terms and any disputes arising out of them are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.


Any disputes shall be resolved through binding arbitration in Frederick County, Maryland, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). 


Each party waives the right to a jury trial and to participate in class or representative actions.


If any claim proceeds in court (where arbitration is not permitted), the parties consent to exclusive jurisdiction in the state and federal courts located in Frederick County, Maryland.


14. Termination


We may suspend or terminate your access to the Services at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Services ceases immediately, and any ongoing obligations under Sections 3, 6, 10, 11, 12, and 13 shall survive termination.


15. Changes to These Terms


We may update these Terms from time to time by posting a revised version on the Site. Your continued use of the Services after the “Last Updated” date constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
