These Terms of Use (“Terms,” “Agreement”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Fourbie Exchange, Inc. (“Fourbie Exchange,” “Company,” “we,” “our,” or “us”) regarding your access to and use of our website at https://www.fourbieexchange.com, including any related products, features, tools, or services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Services.

1. About Fourbie Exchange:  Fourbie Exchange, Inc. is a company registered in Maryland, United States, located at 13798 Blythedale Drive, Mount Airy, MD 21771. You may contact us at legal@fourbieexchange.com or (860) 367-3446. The Services are intended for users aged 13 and older. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

2. Use of the Services:  You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
  • Violate any applicable law or regulation
  • Attempt to gain unauthorized access to the Services or related systems
  • Upload or distribute malicious code, spam, or fraudulent content
  • Harvest or collect user information without consent
  • Interfere with or disrupt the integrity or performance of the Services

We reserve the right to suspend or terminate access to the Services at our discretion for violations of these Terms.

3. Marketplace Nature of the Services: Fourbie Exchange is an online marketplace that connects buyers and sellers of vehicles. We do not own, inspect, store, or take possession of any vehicles listed on the Services. We are not a dealer, broker, or agent, and we are not a party to transactions between users.

We do not guarantee:
  • The accuracy, completeness, or reliability of listings
  • The condition, safety, or legality of any vehicle
  • The ability of sellers to sell or buyers to complete transactions

All transactions are entered into solely between users at their own risk.

4. User Accounts:  To access certain features, you may be required to create an account. You agree to:
  • Provide accurate and complete information
  • Maintain the security of your credentials
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts at our discretion.

5. Fees, Subscriptions, and Payments:  Certain features of the Services require payment, including but not limited to listings, featured placements, subscriptions, and optional add-on services (“Paid Services”). By purchasing any Paid Service, you agree to pay all applicable fees as presented at the time of purchase.

Some Paid Services are offered on a recurring basis. By subscribing:
  • You authorize recurring charges to your payment method
  • Your subscription will automatically renew unless canceled before the end of the billing cycle
  • You may cancel at any time via your account or by contacting info@fourbieexchange.com
  • Cancellation takes effect at the end of the current billing period

Certain services are offered as one-time purchases and do not automatically renew.

We may introduce transactional features (e.g., offer submission, payment facilitation, escrow). These may be subject to additional fees disclosed at the time of use.

We may update pricing at any time. For recurring subscriptions, we will provide advance notice of material changes where required by law.

All payments are non-refundable unless otherwise stated. We may issue refunds or credits at our discretion.

Payments are processed through third-party providers (e.g., Stripe). By submitting payment information, you authorize us and our processors to charge your selected payment method.

6. Listings and Seller Responsibilities:  Sellers are solely responsible for the accuracy, completeness, and legality of their listings, including vehicle condition, title status, pricing, and descriptions. You agree not to post misleading, fraudulent, or inaccurate information. We reserve the right to modify, remove, or refuse any listing at our discretion. We do not guarantee that any listing will result in leads, inquiries, or a completed sale.

7. User Content and License:  By submitting content to the Services (“Contributions”), you grant Fourbie Exchange a worldwide, royalty-free, perpetual, transferable license to use, host, reproduce, modify, display, and distribute such content in connection with operating and promoting the Services.

You represent that:
  • You own or have rights to your Contributions
  • Your Contributions do not violate any third-party rights
  • Your Contributions comply with applicable laws and these Terms

8. Communications Between Users:  Users are solely responsible for their interactions with one another. Fourbie Exchange does not guarantee the quality, safety, or legality of communications, inquiries, or transactions conducted on or off the platform. We are not responsible for disputes between users.

9. Third-Party Services:  The Services may integrate with or link to third-party providers (e.g., payment processors, financing providers, analytics tools). We are not responsible for third-party content, services, or practices. Your use of such services is governed by their respective terms.

10. Privacy:  Your use of the Services is subject to our Privacy Policy, which explains how we collect and use your data.

11. Copyright (DMCA):  If you believe content on the Services infringes your copyright, please submit a notice to:

12. Disclaimers:  The Services are provided “as is” and “as available,” without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability:  To the fullest extent permitted by law, Fourbie Exchange shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the greater of:
  • $100, or
  • The total amount you paid to us in the 12 months preceding the claim

14. Indemnification:  You agree to indemnify and hold harmless Fourbie Exchange and its affiliates from any claims, damages, or expenses arising from:
  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights

15. Governing Law and Dispute Resolution:  These Terms are governed by the laws of the State of Maryland. Any disputes shall be resolved through binding arbitration in Frederick County, Maryland under the rules of the American Arbitration Association. You waive the right to a jury trial and to participate in class actions.

16. Termination:  We may suspend or terminate your access to the Services at any time. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.

17. Changes to These Terms:  We may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
